Data protection regulations per DSGVO of the HTC Partner Portal

At the HTC Partner Portal, we take the protection of the data entrusted to us very seriously, and we confirm this here:

With the following data protection information we, Media Trooper GmbH c/o HTC Corporation, explain which personal data we collect about you when you visit our website and use our online services and how we use your data.

The responsible party for data processing, which alone or in cooperation with others determines the means and purpose of data processing, on this website within the meaning of the Data Protection Basic Regulation (DSGVO) is Media Trooper GmbH c/o HTC Corporation, Black-und-Decker-Str. 17b, 65510 Idstein, Germany, datenschutz@mediatrooper.de. The responsible body is a natural or legal person.

Personal data are individual details of your persons, such as your name, e-mail address and IP address. These data are collected by us only as permitted by law.

1. Data Storage

THE STORAGE AND PROCESSING OF YOUR PERSON-RELATED DATA IS EXCLUSIVELY ON SAVED SERVERS IN GERMANY. WE WILL NOT PERFORM ANY STORAGE AND/OR PROCESSING IN ANY OTHER COUNTRY BEFORE A PRIOR DIRECT CONSENT FROM YOU (OPT-IN).

2. Data Collection & Use

What personal data is collected?

Directly collected data

When you register on the website, the following personal data will be collected from you:

  • Title
  • First name, last name
  • Professional status
  • Business e-mail address
  • Business address: Name, postal address, telephone number & website
  • Legitimacy over the activity in the portable radio industry

This data is used to create a user profile for you to use on HTC Partner. Some of the above information may be viewed by other shop employees in your organization.
In addition, a username & password will be created for the user profile. This cannot be viewed by any other user on HTC Partner and is personal.

We process the above information in compliance with Art. 6 para. 1 lit. a DSGVO with your consent. 

Indirectly collected data

Each time you visit our website, information about your use of HTC Partner and your computer can be collected:

  • IP Address
  • Browser
  • Operating system
  • Clicked areas/activities on the website

We process the above information on SERVERS IN GERMANY (OTHER REGULATIONS See point 1 "DATA STORAGE") pursuant to Art. 6 para. 1 lit. f DSGVO on the basis of our legitimate interest to find out which elements arrive at our website best. In this way, we can find ways to improve them and make them more effective.
  
The processing of the clicked areas/activities on the website according to art. 6 para. 1 lit. a DSGVO after prior consent, as well as according to Art. 6 para. 1 lit. f DSGVO to protect our legitimate interests in the best possible provision of relevant information to you. Storage and/or processing in another country will not take place without your prior consent (opt-in). 

 

Events

The following personal information can be collected to register for an event organized by HTC:

  • Company address
  • Title
  • Position
  • Name (first and last name)
  • Contact details (mobile phone number, e-mail address)

The personal data associated with the registration for the event will be processed and used for purposes which serve the implementation of the event as well as for marketing activities within the scope of the event, in accordance with Art. 6 Para. 1 lit. a DSGVO after your consent. By registering, the Partner declares his consent to the storage and use of his personal data. The name and company address are required in order to gain knowledge of who is attending the event. The name can be printed on a personal name badge that you receive at the event so that you can identify yourself as a participant at the event.

Personal data of private individuals who do not work in the company specified when registering will be deleted from the system after the event has taken place. This applies to persons for whom the field "2nd attendee does not work in the shop" or the item "No employee" is selected.

During the event, HTC may use a smartphone or a digital camera to take photos. After the event, these photos will be made available to the event participants in a publicly accessible gallery. Processing is carried out in accordance with Art. 6 Para. 1 lit. a DSGVO after your consent. The gallery will be available online for up to 6 months after the event. If you do not want to be seen on photos or if you want to remove photos, please contact the above-mentioned e-mail address with a detailed description or contact the photographers on site.

We use the email address you provided when registering to send you regular marketing emails with information about HTC, HTC partners and promotions, as well as market research.

By participating in the respective promotion (e.g. an incentive or competition), the participant gives his consent to the storage and use of his personal data. Processing takes place in accordance with Art. 6 Para. 1 lit. a and Art. 6 Para. 1 lit. f DSGVO. Other than stated in Point 1 your data can be submitted to the country of the Promotion (i.e. United Kingdom, if your promotion is published there). Furthermore, the participant agrees to the publication of his first name and abbreviated last name (e.g. Max X.), as well as city name and shop name in all promotion-relevant online media.

HTC and the companies involved in the implementation are further entitled to contact the participant in writing via the e-mail address provided at the time of participation or the contact data provided at the time of registration, if this is conducive to the implementation of the purpose stated here.

 

Comments and U-Likes 

You have the possibility to comment on entries on our site. For this purpose we save the comment and the like as well as the time of creation/entry. The website also displays abbreviated information for each entry.

3. Forwarding Of Data

Personal data will not be passed on to third parties. Excepted from this are the companies commissioned by HTC, which have to access the data in connection with the processing of the respective action, such as logistics companies for sending goods. These companies have been informed that they may only process and use personal data for the purpose of processing promotions. In addition, personal data will only be transferred to government agencies entitled to receive such information within the meaning of the law or if there is a legal basis for the transfer of such data.

 

4. Data Security

We take all necessary measures to ensure the security of your personal data processed in accordance with the legal requirements. Right of confirmation
They shall have the right to obtain confirmation as to whether personal data relating to them are being processed. If you wish to exercise this right of confirmation, please contact our data protection officer or another employee who is responsible for the processing.

Right of access 
You have the right to obtain information about the personal data stored about you and a copy of this information. You are also entitled to the following information:

  • the processing purposes
  • the categories of personal data processed
  • the recipients or categories of recipients to whom the personal data have been or will be disclosed, in particular recipients in third countries or international organisations
  • if possible, the planned duration for which the personal data will be stored or, if that is not possible, the criteria for determining that duration
  • the existence of a right to rectify or erase personal data concerning you or to have the processing limited by the controller or to object to such processing
  • the existence of a right of appeal to a supervisory authority
  • if the personal data are not collected from the data subject: All available information on the origin of the data
  • the existence of automated decision-making, including profiling, in accordance with Article 22 para. 1 and 4 DSGVO and - at least in these cases - meaningful information on the logic involved and the scope and intended effects of such processing for the data subject
  • You also have a right to know whether personal data has been transferred to a third country or to an international organisation. If this is the case, you also have the right to obtain information about the appropriate guarantees in connection with the transfer.

Right to rectification  
You have the right to have any inaccurate data concerning you corrected without delay and/or your incomplete data stored by us completed, taking into account the purposes of processing.

Right Of Deletion
You have the right to demand the deletion of your personal data if the requirements of Art. 17 para. 1 DSGVO are met. However, this right does not apply in particular if the processing is necessary for the exercise of the right to freedom of expression and information, to fulfil a legal obligation, for reasons of public interest or to assert, exercise or defend legal claims.

Right to limitation of processing
You have the right to demand the restriction of the processing of your personal data if the correctness of your data disputed by you is verified, the processing is unlawful and you refuse the deletion of the personal data and instead demand the restriction of the use of the personal data, your personal data is no longer required for the purposes of the processing, but you need it for the assertion, exercise or defence of legal claims or you lodge an objection against the processing according to Art. 21 para. 1 DSGVO and it is not yet certain whether our justified reasons outweigh your reasons.

Right to information
If you have exercised your right to rectification, cancellation or limitation of processing, all recipients to whom the personal data concerning you has been disclosed of such rectification, cancellation or limitation of processing will be informed, unless this proves impossible or involves a disproportionate effort. If you request, we will provide you with information about these recipients.

Right to Data Transfer
You have the right to receive the personal data concerning you that you have provided to us in a structured, common and machine-readable format, and you have the right to transfer such data to another responsible person without being hindered by the responsible person to whom the personal data were provided, provided that this is technically feasible and that the rights and freedoms of other persons are not impaired. 

Revocation
You have the right to revoke your consent at any time for the future. The revocation of your consent does not affect the legality of the processing carried out on the basis of your consent until you revoke your consent. 

Right of appeal
Without prejudice to any other administrative or judicial remedy, you shall have the right to complain to a supervisory authority, in particular in the Member State of your habitual residence, place of work or place of presumed infringement, if you consider that the processing of your personal data is contrary to the DSGVO.

 

Deletion

We process and store the personal data only for the period of time necessary to achieve the storage purpose or if this has been provided for by the European Directive and Regulation Body or another legislator in laws or regulations to which the data controller is subject. 

If the storage purpose no longer applies or if a storage period prescribed by the European Directive and Regulation Body or another competent legislator expires, the personal data will be blocked or deleted routinely and in accordance with the statutory provisions.
